“ Was subject to an 'Order' to have abandoned airframe removed 13-06-2013 Translated from an official Brasilian document : It is action by the ordinary rite with a request for preliminary injunction, filed by the Brazilian Company of Airport Infrastructure - Infraero in the face of Margirius Taxi Aereo Ltda, aiming jurisdictional provision establishing that: i) the removal of scrap aircraft type helicopter (Manufacturer: Bell Helicopter; Model: 222; Serial Number: 47025, Type: ICAO - B222; Habilitation type for pilots: BH22; Prefix: PTHAC) Airport of Sao Paulo / Congonhas, within 48 (forty-eight ) hours, subject to a daily fine, in accordance with Article 287 of the CPC; ii) in the case of a defendant failing to carry out withdrawal, either to scrap the aircraft declared abandoned and the process continues in accordance with Article 1173 of the CPC; iii) an official dispatch to the ANAC to be registered with the Brazilian Aeronautical Registry - RAB, the aircraft leaving certificate, in accordance with Article 117, VI, of the Brazilian Aeronautics Code; iv) the aircraft abandonment statement, the basis of Article 1173 of the CPC, is the evaluated and alienated thing at auction and deducted from the price the expenses and the reward of Infraero, to be arbitrated in an amount not less than five percent the appraised value, in accordance with Article 1234 of the Civil Code and that any balance is reversed in favor of the Federal Government; v) subpoena the Federal Government, pursuant to Article 10 of Law 5862 of 12/12 / 1972.Alega, in short, that the aircraft for civil use lies hangared stay in area, located on the premises of Congonhas airport, and dead since 01/04/1997, generating debts to the airport.
